Questions and answers

How often should periodic health and safety training be conducted?
Periodic OHS training must take place at least every 3 years for manual workers, and annually for particularly hazardous work. For employers and supervisors, engineering and technical staff, and OHS service staff, the maximum interval is 5 years. For administrative and office employees who are required to complete periodic training, it is 6 years (§ 15 of the regulation). Some office employees qualify for the exemption in art. 237³ § 2² of the Labour Code; this exemption does not apply to employees performing remote work.
Are health and safety training mandatory for all employees?
As a rule, employees must complete initial OHS training before starting work. The exception is a consecutive contract with the same employer for the same position held immediately beforehand (art. 237³ § 2 of the Labour Code). Periodic training is not required for an administrative or office employee if the employer's predominant activity belongs to an activity group with a risk category no higher than 3, unless the occupational risk assessment makes training necessary. This exemption does not apply to employees performing remote work. For civil-law contracts, the required training depends on the type of work and its hazards.
Who can conduct health and safety training?
The training organiser must provide lecturers and instructors with appropriate knowledge, professional experience and teaching preparation (§ 5 item 3 of the regulation). Initial training has additional rules: general instruction is delivered by the persons listed in § 10(2), while job-specific instruction is delivered by a designated supervisor or the employer, with the required qualifications, experience and training in instruction methods (§ 11(5)).
Can an employer be punished for lack of health and safety training?
Yes. Failing to provide required OHS training may constitute an OHS violation. Since 8 July 2026, art. 283 § 1 of the Labour Code provides for a fine of PLN 2,000 to PLN 60,000 for such violations. This is not the amount of an on-the-spot ticket issued directly by a PIP inspector; ticket proceedings have separate limits.
